GOOD FAITH DEPOSIT
An initial deposit of $20,000.00 must be expedited to "Kerzner International Limited, Executive Office - Attn: Deanka Edwards, 1 Casino Dr., Paradise Island, Nassau NP, Bahamas" after submitting this form electronically. Checks and payments to be made payable to "Paradise Island Limited - Client Escrow Account", which shall be deposited by Developer in a non-interest-bearing account. Payments to be made by checks drawn on a bank in The Bahamas, Banker's Draft or wire transfer. Remittance instructions for wire transfer of funds are available on request.
THE NEXT STEP - ALLOCATION AND PURCHASE CONTRACT
It is expected that in March, 2005, Interested Parties will be contacted and advised of pricing and availability on their preferred Units listed above, and will be given an opportunity to confirm in writing their interest in purchasing the allocated Unit(s). Once written confirmation is received, a contract for purchase on Developer's standard form purchase contract ("Purchase Contract") will be prepared and mailed or delivered to the Interested Party. The Interested Party shall (a) sign and return the Purchase Contract to the Developer, together with the Earnest Money Deposit required under the Purchase Contract, within fifteen (15) business days after Interested Party has received the Purchase Contract, and (b) the funds deposited under this Agreement shall be credited against the Earnest Money Deposit. In the event that an executed Purchase Contract and Earnest Money Deposit is not received within the said fifteen (15) business days, the Developer may allocate the Unit to other prospective Purchasers, and the initial deposit shall be returned to the Interested Party.
This document does not bind either party. In particular, the Developer makes no representation as to the priority of any given interest, or the availability of any given Unit, unless and until a formal Purchase Contract is entered into between the parties. The initial deposit may be recalled or repaid at any time.
